Love Tunes Platform. ("Love Tunes," "we," "us," or "our") offers our services (described below) and related content through our website at https://lovetunes.io/ (the "Site"). Collectively, the Site along with any content, tools, features, and technology provided through them, are referred to as the "Service." Accessing or using the Service is subject to these Terms of Service ("Terms"). By using the Site or any part of the Service, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Service.

We may modify these Terms at any time at our discretion. If changes are made, we will post the updated Terms on this page and update the revision date at the top. A current version of these Terms can be viewed by visiting the "Terms of Service" link on the Site. We will also notify you of significant changes via the Service interface, pop-up notice, email, or other reasonable means. Continued use of the Service after changes become effective indicates your acceptance of the new Terms. Regularly review this page to stay informed of any changes. Use of the Service

Service Description: The Service processes your input data, such as code, video, images, information, text, software, music, sound, photos, graphics, messages, and other materials ("Submissions"), and generates and returns audio and visual output ("Output"). Together, the Submissions and Output are referred to as "Content." The Service may also include a public forum for sharing Content with other users.

Only upload Submissions you have the rights to use. By uploading any Submission, you represent and warrant that:

You have all necessary rights, licenses, consents, permissions, power, and authority to use the Submission and allow us to use it in connection with the Service, including generating Output.
Your Submissions and their use by the Service will not violate any laws or third-party rights.
No additional licenses, permissions, consents, or payments are required for us to use your Submissions, generate Output, or improve the Service and its related AI or machine learning models.

Your Registration Obligations: To access and use certain features of the Service, you may need to register with Love Tunes and provide information about yourself (e.g., name, email address). You agree to provide and maintain true, accurate, current, and complete information as prompted by the Service's registration form. Registration data is governed by our Privacy Policy. You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with your parent's or guardian's consent and must provide true, accurate, current, and complete information as requested by Love Tunes to confirm such consent. We may offer a free tier of the Service but limit account creation to prevent misuse. If we believe the free tier is being abused, we may discontinue your access and refund any pre-paid fees on a pro-rata basis.

Member Account, Password, and Security: You are responsible for maintaining the confidentiality of your password and account details. You are fully responsible for all activities under your account. You agree to immediately notify Love Tunes of any unauthorized use of your account or other security breaches. Ensure you exit your account at the end of each session. Love Tunes is not liable for any loss or damage arising from your failure to comply with this.

Modifications to Service: Love Tunes may modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. You agree that Love Tunes is not liable to you or any third party for any such actions.

General Practices Regarding Use and Storage: Love Tunes may establish general practices and limits regarding the use of the Service, including the maximum retention period for data and the maximum storage space allotted on Love Tunes's or third-party servers. Love Tunes reserves the right to terminate inactive accounts, including all associated Submissions and Output. These practices and limits may change at any time, at Love Tunes's discretion, with or without notice.

Conditions of Access and Use

User Conduct: You are fully responsible for how you use the Service and any Submissions you provide to Love Tunes, whether by uploading through the Service, emailing, or sharing with other users. This includes any Outputs you generate via the Service. You bear all risks related to Submissions, including their transmission, and are solely accountable for their accuracy, quality, legality, and appropriateness. Posting Content on the Service does not imply approval or endorsement by Love Tunes. Love Tunes disclaims any liability related to Content or any use of the Service. You must not use the Output to compete with Love Tunes by creating competing products or services. Below is a list of prohibited Submissions or uses. Love Tunes reserves the right to investigate and take legal action against anyone who, at our sole discretion, violates this provision. This may include removing offending content, suspending or terminating accounts, and reporting violators to law enforcement.

You agree not to use the Service to:

Upload, transmit, or make available any Submissions or direct the Services to generate any Output that:

Infringes on any intellectual property or other proprietary rights of any party.
You do not have the right to upload under any law or under contractual or fiduciary relationships.
Contains viruses or harmful code designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment.
Poses a privacy or security risk to any person.
Constitutes unsolicited or unauthorized advertising, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, discriminatory, or otherwise objectionable.
Restricts or inhibits any other person from using the Service or may expose Love Tunes or its users to any harm or liability.

Interfere with or disrupt the Service or servers or networks connected to the Service.
Violate any applicable local, state, national, or international law.
Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
Solicit personal information from anyone under 18.
Post private information or collect email addresses or other information about another user without their consent.
Advertise or offer to sell or buy any goods or services for any business purpose not authorized by Love Tunes.
Imply that Love Tunes endorses any of your Submissions, Outputs, statements, or positions.
Promote any criminal activity or provide instructional information about illegal activities.
Obtain or attempt to access any content or information through unauthorized means.
Use the Services to create or improve competing products or services or to train other AI models.
Circumvent content protections or geographic restrictions on any content available through the Service, including through the use of VPNs.
Engage in data mining, scraping, or similar data gathering methods.

If you are blocked by Love Tunes from accessing the Service, you agree not to use any measures to circumvent such blocking (e.g., by masking your IP address or using a proxy).

Fees: If the Service or any portion of it is available for a fee, you may need to select a payment plan and provide credit card or other payment information. You represent and warrant that the information is true and that you are authorized to use the payment method. You will promptly update your account information with Love Tunes or the payment processor of any changes. You agree to pay Love Tunes the specified amount in accordance with the payment plan and these Terms. If your payment plan includes an ongoing subscription, you authorize Love Tunes to bill your payment method periodically until you terminate your account. If you dispute any charges, you must notify Love Tunes within 60 days. Details on subscription offerings, including prices, are available at https://lovetunes.io/profile/credits. Love Tunes reserves the right to change prices.

Payment Processing: Love Tunes does not process payments for the Service. Payments are facilitated by Stripe, Inc. and its affiliates ("Stripe"). These services are subject to Stripe's terms and policies available at https://stripe.com/legal and https://stripe.com/privacy. By using the payment functions, you agree to be bound by the Stripe Agreements. You authorize Stripe to store and bill your payment method to avoid interruptions. Love Tunes is not liable for payments made through Stripe.

Subscription and Cancellation: Love Tunes may offer a subscription-based service with a recurring payment plan (e.g., monthly, quarterly, annually). Upon enrolling, your account will be charged according to the selected plan. You must cancel your subscription at least one day before the end of the billing period to avoid automatic renewal. To cancel, visit the subscription management page on Love Tunes. Canceling your subscription will stop future charges, but you may lose access to paid features. No refunds are given for partially used periods. Love Tunes reserves the right to adjust subscription pricing or fees, with advance notice of changes.

Third-Party Websites and Services: The Service may contain links to third-party websites or services not owned or controlled by Love Tunes. Love Tunes is not responsible for any third-party websites or services, including their content, policies, or practices. You agree that Love Tunes is not liable for any loss or damage incurred from your use of any third-party website or service. Please review the terms and conditions and privacy policies of any third-party websites or services before using them. The Service may include third-party features or integrations, such as social media sharing buttons or analytics tools, subject to third-party terms. By using these features, you agree to the third-party terms governing your use.

Intellectual Property Rights

Service Content: The Service and its original content, features, and functionality are and will remain the exclusive property of Love Tunes and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Love Tunes. All goodwill generated from the use of our trademarks benefits us.

Submissions and Outputs: As between you and Love Tunes, you retain ownership of any intellectual property rights in your Submissions. By uploading a Submission to the Service, you grant Love Tunes a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display the Submission in connection with the Service. You also grant each user of the Service a non-exclusive license to access your Submissions through the Service and use, reproduce, distribute, display, and perform such Submissions as permitted by these Terms. Outputs are owned by Love Tunes and licensed to you under these Terms. Love Tunes retains all right, title, and interest in and to the Service, including all associated intellectual property rights. You agree not to challenge or interfere with Love Tunes's ownership of such rights.

Feedback: You may submit feedback, suggestions, or ideas about the Service to Love Tunes ("Feedback"). By submitting Feedback, you grant Love Tunes a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display the Feedback in any manner. Love Tunes has no obligation to implement your Feedback, and you are not entitled to any compensation for it.

Disclaimers and Limitation of Liability

Service Disclaimers: The Service is provided on an "as is" and "as available" basis. Love Tunes makes no warranties, express or implied, regarding the Service or any content, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Love Tunes does not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate, complete, or reliable. Your use of the Service is at your own risk. Love Tunes is not responsible for any third-party content accessible through the Service.

Limitation of Liability: To the fullest extent permitted by applicable law, Love Tunes and its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages. In no event shall Love Tunes's total liability to you for all claims related to the Service exceed the amount paid by you to Love Tunes in the past twelve months or one hundred dollars ($100), whichever is greater.

Indemnification: You agree to indemnify, defend, and hold harmless Love Tunes and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your Submissions or Outputs, your violation of these Terms, or your violation of any law or the rights of a third party. Love Tunes reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with Love Tunes's defense of such claims.

Miscellaneous

Governing Law: These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.

Termination: Love Tunes may terminate or suspend your account and access to the Service, at its sole discretion, for any reason, with or without notice. Upon termination, your right to use the Service will immediately cease, and any licenses granted to you will be terminated. If you wish to terminate your account, you may do so by discontinuing your use of the Service. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Entire Agreement: These Terms constitute the entire agreement between you and Love Tunes regarding the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Love Tunes regarding the Service. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: No waiver by Love Tunes of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by Love Tunes to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
